Terms of Service

The agreement between you and Trundle covering use of the application, subscriptions and what each of us is responsible for.

1. Who these terms are with

These terms are an agreement between you and Timothy Duddy, d/b/a Trundle, a sole proprietorship in the United States ("we", "us"). By downloading, installing or using Trundle, you accept them. If you do not accept them, do not use the application.

2. Your licence to use the software

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Trundle on computers you own or control, for as long as these terms are in effect. Paid features are unlocked by the plan attached to your account, not by a key, so you may sign in on your own machines without a device limit.

The software is licensed, not sold. We keep all intellectual property rights in it. You keep all rights in everything you produce with it — your streams, recordings, clips and shot data are yours, and we claim no licence over them.

3. Accounts

Some features require an account, created by signing in with Google. You are responsible for keeping access to that Google account secure, and for activity that happens under your account. You must be at least 13 years old, and old enough to enter a contract where you live, to hold one. Tell us at support@gettrundle.com if you believe your account has been misused.

4. Plans, billing and cancellation

Trundle has a free tier and paid Creator and Pro subscriptions. What each tier includes is listed on our pricing page.

  • Payments are handled by Paddle. Paddle Payments Inc. and its affiliates act as our Merchant of Record. They are the seller on your receipt, they take the payment, and they handle sales tax and VAT. Their buyer terms apply to the transaction alongside these terms.
  • Subscriptions renew automatically at the interval you chose, monthly or yearly, at the price then displayed, until cancelled.
  • You can cancel at any time from your account page. Cancelling stops the next renewal; your plan keeps working until the end of the period you have already paid for, and is not prorated.
  • Prices can change.We will give you at least 30 days' notice by email before a change affects your renewal, and you can cancel before it takes effect.
  • Failed payments. If a renewal fails, paid features may be suspended until payment succeeds. Your locally stored data is never affected by this.

5. Refunds

We offer a full refund within 14 days of a charge, for any reason. The details, including how to request one, are in our Refund Policy, which forms part of these terms. Nothing in these terms limits refund or cancellation rights you have under the consumer law of your own country.

6. Acceptable use

You agree not to:

  • Copy, resell, sublicense or redistribute the software, or share paid access with people outside your household.
  • Reverse-engineer, decompile or attempt to derive the source code, except where that restriction is prohibited by law.
  • Work around plan limits, licence checks, usage allowances or the watermark on the free tier.
  • Use the application to break the terms of any service it works alongside, including GSPro, YouTube and Twitch.
  • Use it to record, stream or analyse people without whatever consent the law where you are requires. Your cameras are your responsibility.
  • Attack, overload or probe our servers, or attempt to gain access to accounts that are not yours.

7. AI swing analysis

AI swing analysis produces an automated opinion from a handful of video frames. It is information, not coaching, and it is not a medical or physiotherapy assessment. It can be wrong. Do not rely on it for decisions about injury, rehabilitation or physical training, and use your own judgement before changing how you swing. Paid plans include a monthly allowance of analyses; we may apply reasonable limits to prevent abuse.

8. Third-party services and hardware

Trundle is an independent product. It is not affiliated with, endorsed by or sponsored by GSPro, YouTube, Google, Twitch, or any launch monitor or camera manufacturer. Those services are controlled by their owners, who can change or withdraw them at any time, and we cannot promise that Trundle will keep working with them if they do.

9. Availability and changes to the product

We may add, change or remove features, and we may update the application automatically. We aim to keep the service running but do not promise uninterrupted availability. If we discontinue a paid feature you are actively paying for, you may cancel and we will refund the unused part of your current period.

10. Your data and backups

Your rounds, clips and settings are stored on your own computer, and keeping backups of them is your responsibility. We have no copy and cannot restore them. How we handle the information we do hold is described in our Privacy Policy.

11. Disclaimer of warranties

Trundleis provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be error-free or uninterrupted, or that it will work with every simulator, camera, capture device or streaming setup. Some jurisdictions do not allow these exclusions, in which case they do not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost streams, lost recordings, lost data, lost profits or lost opportunities, arising from your use of Trundle. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

13. Suspension and termination

You may stop using Trundleat any time, cancel your subscription from your account page, and ask us to delete your account. We may suspend or terminate access if you materially breach these terms — and, except where the breach makes it impracticable, we will tell you why and give you a chance to put it right first. If we terminate your account without cause, we will refund the unused part of your current period.

14. Changes to these terms

We may update these terms. For material changes we will give notice by email to account holders, or in the application, before they take effect. Continuing to use Trundle after that means you accept the updated terms; if you do not, cancel and stop using it.

15. Governing law

These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules, and the courts located in Oregon will have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws of the country you live in, or of your right to bring proceedings there.

16. General

If any provision of these terms is found unenforceable, the rest continues to apply. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours if the business is sold, provided your rights are not reduced. These terms, together with the Privacy Policy and Refund Policy, are the whole agreement between us.
